Welcome to Canadawn Inc. These Terms of Service (“Terms”) govern your access to and use of Canadawn.com and your purchase or use of our private transportation, airport transfer, sightseeing tour, day trip, and related services.

By accessing our website, requesting a quote, making a booking, or using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.

1. About Canadawn Inc.

Canadawn Inc. provides private transportation and sightseeing services in Toronto, Ontario, and surrounding areas.

Our services may include:

  • Airport transfers
  • Private transportation
  • Toronto sightseeing tours
  • Niagara Falls tours
  • Day trips and excursions
  • Private group transportation
  • Other transportation services offered through Canadawn.com

Specific services, routes, vehicles, prices, and availability may vary.

2. Eligibility

You must provide accurate and truthful information when using our website or booking our services.

If you make a booking on behalf of another passenger or group, you are responsible for ensuring that the passengers are informed of these Terms and any applicable booking requirements.

3. Bookings and Reservations

A booking request submitted through Canadawn.com does not necessarily constitute a confirmed reservation.

A reservation becomes confirmed when Canadawn Inc. has accepted the booking and, where applicable, payment or other required booking information has been received.

Customers are responsible for reviewing their booking details and notifying Canadawn Inc. promptly if any information is incorrect.

4. Information Required for Booking

Depending on the service, we may require information such as:

  • Customer name
  • Telephone number
  • Email address
  • Pickup location
  • Drop-off location
  • Date and time of travel
  • Flight information
  • Number of passengers
  • Luggage information
  • Vehicle requirements
  • Special requests

Customers are responsible for ensuring that the information they provide is accurate and complete.

Incorrect or incomplete information may affect our ability to provide the requested service.

5. Pricing and Payment

Prices displayed on Canadawn.com may vary depending on the service, vehicle, route, number of passengers, travel requirements, date, and other applicable factors.

Unless otherwise stated at the time of booking, the applicable price will be the price communicated or confirmed by Canadawn Inc. for the reservation.

Additional charges may apply where reasonably applicable, including charges associated with:

  • Additional waiting time
  • Significant route changes
  • Additional stops
  • Changes in pickup or drop-off locations
  • Additional distance or travel time
  • Parking
  • Tolls
  • Special vehicle requirements
  • Additional services requested by the customer
  • Other costs arising from changes to the original booking

Where reasonably possible, customers will be informed of additional charges before they are incurred or before a booking change is confirmed.

6. Taxes and Fees

Applicable taxes, fees, and other charges may be included in or added to the displayed or quoted price depending on the service and applicable requirements.

Customers are responsible for paying the applicable total amount shown at checkout, in a quotation, or in the confirmed booking.

7. Payment Processing

Payments may be processed through third-party payment providers.

By submitting payment information, you authorize the applicable payment provider to process the transaction according to its terms and policies.

Canadawn may not have access to complete payment card information processed directly by a third-party payment provider.

8. Cancellation and Refunds

Cancellation and refund requests are governed by Canadawn's Refund & Cancellation Policy, unless different terms have been expressly provided for a specific booking.

Unless otherwise stated:

  • 48 hours or more before pickup: generally eligible for a full refund.
  • 24–48 hours before pickup: generally eligible for a 50% refund.
  • Less than 24 hours before pickup: generally non-refundable.
  • No-shows: generally non-refundable.

Special events, large groups, custom bookings, and certain other services may be subject to different cancellation terms.

9. Booking Changes

Customers may request changes to their reservation, subject to availability.

Changes may include:

  • Pickup or drop-off location
  • Date or time
  • Passenger count
  • Vehicle type
  • Flight information
  • Additional stops
  • Special requirements

A change may result in an additional charge.

Canadawn Inc. does not guarantee that requested changes can be accommodated.

10. Pickup and Drop-Off

Customers are responsible for being available at the agreed pickup location at the scheduled time.

Customers should ensure that the pickup location is accurate, accessible, and safe for the vehicle and driver.

Where appropriate, the customer may be contacted by telephone, text message, email, or other communication method regarding pickup arrangements.

11. Airport Transportation

For airport transfers, customers should provide accurate flight information when requested.

Canadawn Inc. may monitor flight information and make reasonable efforts to coordinate airport pickups around known flight delays or schedule changes.

Flight monitoring does not guarantee that every flight disruption can be accommodated.

Customers should contact Canadawn Inc. as soon as possible if their flight is cancelled, diverted, significantly delayed, or changed.

12. Waiting Time

Customers are expected to be ready at the scheduled pickup time.

Reasonable waiting procedures may differ depending on the service, pickup location, airport, traffic conditions, and booking arrangements.

Extended waiting caused by the customer may result in additional charges.

If the customer cannot be located or reached after a reasonable waiting period and reasonable attempts to contact them have been made, the booking may be treated as a no-show.

13. No-Show

A customer may be considered a no-show if they:

  • Fail to appear at the agreed pickup location
  • Cannot reasonably be located
  • Do not respond to reasonable attempts to contact them
  • Fail to provide necessary information required to complete the pickup
  • Arrive after the applicable waiting period without prior communication

No-show bookings are generally non-refundable.

14. Travel Time and Routes

Estimated travel times displayed on Canadawn.com are estimates only.

Actual travel time may vary due to:

  • Traffic
  • Weather
  • Road construction
  • Accidents
  • Road closures
  • Airport congestion
  • Public events
  • Emergencies
  • Unexpected transportation conditions
  • Other circumstances outside Canadawn's reasonable control

Canadawn Inc. may select a reasonable route based on traffic, safety, road conditions, and operational considerations.

15. Vehicle Assignment

Canadawn Inc. may offer different vehicle types, including sedans, SUVs, and minivans.

A specific vehicle model may not always be guaranteed unless expressly confirmed as guaranteed at the time of booking.

Canadawn Inc. may substitute a vehicle with another comparable vehicle when reasonably necessary due to availability, maintenance, safety, operational requirements, or unforeseen circumstances.

Any replacement vehicle will, where reasonably possible, be suitable for the passenger and luggage requirements stated in the reservation.

16. Passenger and Luggage Requirements

Customers are responsible for providing accurate information regarding:

  • Number of passengers
  • Amount and size of luggage
  • Child or infant seating requirements
  • Mobility requirements
  • Other special transportation needs

Canadawn Inc. cannot guarantee that a vehicle will safely accommodate passengers or luggage if accurate information was not provided at booking.

For safety reasons, the driver may decline transportation when the number of passengers or amount of luggage exceeds the vehicle's safe capacity.

17. Child Safety and Car Seats

Customers traveling with infants or children are responsible for communicating applicable child-seat requirements before booking.

Where a child safety seat is required by applicable law, the customer must ensure that an appropriate seat is available and properly used unless Canadawn Inc. has expressly confirmed that an appropriate seat will be provided.

Passengers must comply with applicable seat-belt and child-restraint requirements.

18. Passenger Conduct

Customers and passengers must behave respectfully and safely while using Canadawn Inc. services.

The following conduct may result in refusal or termination of service:

  • Threatening or abusive behavior
  • Harassment
  • Violence or intimidation
  • Deliberate damage to the vehicle
  • Unsafe behavior
  • Excessive intoxication that creates a safety concern
  • Illegal activity
  • Refusal to follow reasonable safety instructions
  • Any conduct that places the driver, passenger, public, or vehicle at unreasonable risk

Where service is terminated because of passenger misconduct, a refund may not be provided.

19. Smoking, Vaping, and Damage

Smoking and vaping may be prohibited inside Canadawn Inc. vehicles.

Passengers must not intentionally or negligently damage, soil, or misuse a vehicle.

Customers may be responsible for reasonable costs arising from:

  • Vehicle damage
  • Excessive cleaning
  • Spills or stains
  • Smoke or vaping contamination
  • Vomit or other biohazard cleanup
  • Lost or damaged vehicle equipment
  • Other unreasonable damage caused by a passenger

Where applicable, the customer may be charged for the reasonable cost of repair, replacement, or specialized cleaning.

20. Prohibited Items and Illegal Activities

Passengers may not transport illegal, dangerous, or prohibited items in Canadawn Inc. vehicles.

Customers must comply with all applicable federal, provincial, and municipal laws.

Canadawn Inc. may refuse transportation where there is a reasonable safety, legal, or security concern.

21. Driver and Safety Authority

Canadawn Inc. drivers are expected to operate vehicles safely and professionally.

For safety reasons, the driver may make reasonable decisions concerning:

  • Safe stopping locations
  • Vehicle loading
  • Passenger capacity
  • Route selection
  • Weather or road conditions
  • Unsafe pickup or drop-off locations
  • Passenger conduct
  • Other safety-related matters

Customers and passengers must follow reasonable safety instructions from the driver.

22. Tours and Sightseeing Services

Canadawn Inc. sightseeing tours and day trips are designed to provide private transportation and sightseeing experiences.

Tour itineraries, attractions, routes, and stops may vary depending on:

  • Weather
  • Traffic
  • Road conditions
  • Attraction operating hours
  • Seasonal conditions
  • Closures
  • Customer preferences
  • Safety considerations
  • Time limitations
  • Other circumstances outside Canadawn's reasonable control

Admission fees, parking fees, attraction tickets, meals, and other expenses are not included unless specifically stated in the applicable tour description or booking.

23. Attraction and Third-Party Availability

Canadawn Inc. does not control third-party attractions, restaurants, parks, airports, venues, or other destinations.

We are not responsible for:

  • Attraction closures
  • Changed operating hours
  • Sold-out tickets
  • Cancellations by third parties
  • Restricted access
  • Temporary closures
  • Changes to attraction policies
  • Events or circumstances affecting third-party facilities

Customers are responsible for any third-party admission requirements unless Canadawn Inc. has expressly agreed to arrange them.

24. Weather and Road Conditions

Canadian weather and road conditions can change quickly.

Canadawn Inc. may modify, delay, reroute, or cancel transportation or sightseeing activities when reasonably necessary for safety.

Where possible, we will communicate material changes to affected customers.

25. Unavoidable Events and Force Majeure

Canadawn Inc. will not be responsible for delays, cancellations, interruptions, or inability to provide services caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Severe weather
  • Natural disasters
  • Major accidents
  • Road closures
  • Traffic emergencies
  • Airport disruptions
  • Government restrictions
  • Public emergencies
  • Civil disturbances
  • Infrastructure failures
  • Strikes or transportation disruptions
  • Other extraordinary or unforeseeable events

Where reasonably possible, Canadawn Inc. will attempt to provide an alternative arrangement.

26. Personal Belongings

Customers are responsible for their personal belongings, luggage, electronics, documents, valuables, and other property.

Customers should not leave valuables unattended in vehicles.

Canadawn Inc. is not responsible for loss, theft, or damage to personal belongings except to the extent responsibility cannot lawfully be excluded or limited.

If you leave an item in a vehicle, contact us as soon as possible at info@canadawn.com.

Reasonable efforts may be made to locate and return recovered property. Delivery or shipping costs may apply.

27. Website Information

Canadawn Inc. makes reasonable efforts to keep website information accurate and current.

However, information on the website may occasionally contain errors, omissions, outdated information, or inaccuracies.

We reserve the right to correct errors and update website content, pricing, availability, routes, vehicles, and service descriptions without prior notice where appropriate.

28. Website Availability

We do not guarantee that Canadawn.com will always be available, uninterrupted, secure, or free of technical errors.

Website availability may be affected by maintenance, technical problems, hosting issues, network disruptions, cyber incidents, or other circumstances beyond our reasonable control.

29. Intellectual Property

Unless otherwise stated, content appearing on Canadawn.com, including text, graphics, photographs, logos, branding, designs, layouts, and other materials, belongs to Canadawn Inc. or its respective licensors.

You may not reproduce, copy, modify, distribute, publish, sell, license, or commercially exploit our website content without prior written permission, except where permitted by applicable law.

Canadawn.com may contain links to third-party websites, platforms, payment services, mapping services, or other external resources.

These third parties operate independently from Canadawn Inc.

Canadawn Inc. does not guarantee a particular travel time or arrival time unless expressly agreed otherwise in writing.

Customers are responsible for allowing sufficient time for airport check-in, boarding, connections, events, appointments, tours, and other scheduled activities.

We strongly recommend allowing additional travel time when traveling during peak traffic, severe weather, holidays, or other periods of potential delay.

34. Indemnification

To the extent permitted by applicable law, you agree to be responsible for reasonable losses, claims, damages, liabilities, costs, and expenses arising from your unlawful conduct, intentional misconduct, or material violation of these Terms.

This provision does not apply to the extent the loss results from Canadawn's own negligence or conduct for which liability cannot legally be transferred to the customer.

Nothing in these Terms prevents you from exercising any rights or remedies available to you under applicable law.

36. Governing Law

These Terms are intended to be governed by the applicable laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be subject to the jurisdiction of the courts or other legally authorized dispute-resolution bodies applicable to the relevant matter and location.

37. Changes to These Terms

Canadawn Inc. may update these Terms from time to time to reflect changes in our services, business practices, website, legal requirements, or operational procedures.

The updated version will be posted on Canadawn.com with a revised effective date.

Your continued use of the website or services after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.

38. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

The invalid or unenforceable provision will be interpreted or modified to the extent necessary to make it enforceable while preserving its intended purpose as closely as possible.

These Terms, together with any applicable booking terms, Refund & Cancellation Policy, Privacy Policy, and other terms expressly incorporated into your booking, constitute the agreement governing your use of Canadawn's website and services, except where a separate written agreement applies.
